„The diversity of a free society would be jeopardized if it were no longer possible to form associations consisting only of fat people, tall men, bald men, war veterans, blue-eyed people, black-haired people, millionaires, compatriots or ex-convicts.“ This concise quote of Traub (WRP 1985, 591, 598) describes the constitutionally guaranteed right of every association to freely choose its members. However, this freedom cannot exist without boundaries because every person also has the right to join associations of his or her choosing. The central questions of this book deal with this area of tension. The German constitutional and European union’s framework are explored, as well as different bases for claims to join an association such as § 20 section 5 GWB and § 826 BGB. The heart of this doctoral thesis is § 18 AGG, whose in part unsuccessful implementation of EU guidelines has left considerable room for interpretation. It has so far not been the focus of scientific discussion. This book therefore gives a good overview of the topic.
