The Author is dealing with the constitutional legality of pharmacological neuro enhancement from the perspective of self-directed, other-directed and mutually agreed performance stimulation.

The most commonly misused medications for performance enhancement are initially listed, to then illustrate their effectiveness and dissemination. Following the differentiation of the terms neuro enhancement and therapy, is the debate of ethnic objections in neuro enhancement. In the course of this “Human Nature” is addressed along with potential loss of individuality and social exclusion.

Subsequent to the question, if legal norm lex lata is managing the approach to neuro enhancement sufficiently, the main part is dealing with the constitutional analysis of especially the interests of basic right, which protect personal freedom and self-determination. The legality of self- and other-directed neuro enhancement is validated not only in Art. 1 Par. 1 GG, Art. 2 Par. 1 i.V.m. Art. 1 Par. 1 and Art. 4 Par. 1 GG, but also intensively in Art. 2 Par. 2 S. 1 GG because of the potential health risks. Particular attention is paid to the special position of minors which is worth protecting.

The main part is closing, following a comprehensive discussion of general equality and equality of opportunity including an audit of basic interests of pharmaceutical corporations, in which professional freedom and freedom of research are in focus.

In conclusion, the author is illustrating the legislative possibilities, which should protect not only improvement averse individuals from forced ingestion but also children and teenager in case of an increasing disposition towards neuro enhancement.
